Symposium in Catastrophic Personal Injuries and Clinical Negligence 2023

Presentations in clinical negligence will provide an update on plentiful recent case law and provide a single case study (on CNZ) addressing complex and controversial issues of causation, material contribution and divisible injury in birth asphyxia claims. In the personal injury stream, we will leave behind the re-writing of the law covering accommodation and look at the many individual findings in the amputee case of Swift v Carpenter touching on prosthetics, equipment and the finer detail of the judgment.
Our attention will also turn to cases involving paraplegia, with the focus on maximising mobility and preparation of the required evidence. We will also consider the decision in Martin v Salford, which contains a number of learning outcomes. To view the paper, please click here
