Serious Personal Injury Litigation – Quantum Updated to 2026

James Rowley KC has today re-published his now 20-year survey of reported cases in the above work updated to 20 April 2026.
This update includes the traumatic brain injury case of PHJ v HMA (2024) and the partial paraplegia case of Wilson v Ministry of Justice (2024). There are many references to both in the main text and they appear now, with the fine detail distilled, alongside CCC v Sheffield Teaching Hospitals (2023) in Table 5.
The lost years chapter is revised for the Judgment of the Supreme Court in CCC (2026).
Shepherdson v Kirby (2025) enters the text for future care and case management but not Table 5 given the limited scope of the decision.
The very recent decision in Lynch v Princess Alexandra Hospital NHS Trust (2026) makes it into the text covering the normal measure of damage in personal injuries litigation and, briefly, in respect of provisional damages.
There are further additions for smaller cases and the text is generally brought up to date.
Readers who missed the 2024 update will find a substantial chapter on provisional damages and variable PPOs added since they last looked.
