James describes the increasingly popular, hybrid approach to mediation in large loss personal injury claims, which blends facilitative and evaluative techniques. The approach allows a mediator - with real subject matter expertise - actively to help the participants steer towards settlement. He highlights the importance of selecting the right mediator and suggests strategies to prepare for and engage in a mediation to best effect.
