Simon Kilvington QC - Judgment on Contributory Negligence

Claimant success on contributory negligence for speeding motorcyclist:

 

Simon Kilvington QC, Instructed by Caroline Morris of Fletchers Solicitors,  represented the successful Claimant who had accelerated to 55-60mph in a 40mph zone when the Defendant lorry driver turned across his path, leaving him with catastrophic injuries. The Defendant submitted at trial that contributory negligence should be in the region of 75-80% but the Court accepted the Claimant’s case that would be fundamentally wrong, taking off only 25%.
